SALCBC is part of a coalition, intervening in 2 separate cases at the Supreme Court of Canada

The South Asian Legal Clinic of British Columbia (SALCBC) is part of a coalition with SABA Toronto and South Asian Legal Clinic of Ontario (SALCO), intervening in 2 separate cases at the Supreme Court of Canada.

SALCBC is excited to announce that it has been granted intervenor status in the upcoming hearing of Ahluwalia v. Ahluwalia at the Supreme Court of Canada.

The Ahluwalia case is an appeal from the Ontario Court of Appeal on the issue of whether a distinct tort of family violence can exist. While the Ontario Superior Court ruled in favour of extending the common law and creating this new tort, the Ontario Court of Appeal declined to recognize a separate tort of family violence.

Intimate partner violence and gender-based violence is an issue that affects many families in South Asian communities. As a coalition with the South Asian Legal Clinic of Ontario and SABA Toronto, SALCBC will be intervening to provide its perspective on this important issue.

SALCBC thanks its counsel on this matter, Neha Chugh, for her hard work. With this decision, we are now set to intervene in two cases at the Supreme Court this year (the other being Mehralian v. Dunsmore).
